505 Anglers LLC General Terms and Conditions
These General Terms and Conditions ("Agreement") constitute a legally binding agreement between 505 Anglers LLC ("Provider," "we," "us," or "our") and the individual or entity/entities ("Client," "you," or "your") engaging our fishing experience/guide services. By booking or participating in our service, you agree to be bound by the terms and conditions outlined below:
1. Booking and Confirmation:
1.1. Booking Requests: To initiate a booking, the Client must submit a booking request through our website, email, or other authorized channels. The booking request should include the desired date(s), number of participants, and any special requests.
1.2. Confirmation: A booking is considered confirmed only upon receipt of full payment or a deposit as specified by us. We reserve the right to refuse any booking request.
2. Payment:
2.1. Payment Schedule: The Client agrees to pay the total amount as specified in the booking confirmation. Payment can be made via methods indicated by us, such as credit/debit cards, bank transfers, or other approved forms of payment.
2.2. Deposits: For certain bookings, a non-refundable deposit may be required at the time of booking. The deposit amount will be communicated to the Client during the booking process.
3. Cancellations and Refunds:
3.1. Client Cancellations: If the Client cancels the booking, the following cancellation charges may apply:

4. Participation Requirements:
4.1. Health and Fitness: The Client acknowledges that participation in fishing activities requires a reasonable level of physical fitness and health. It is the responsibility of the Client to ensure that they are physically capable of participating safely. *Accessibility or Special Accommodations are evaluated on a case by case basis.
4.2. Age Restrictions: Children under 12 may need to be accompanied by a responsible adult depending on activity and location. Age restrictions will be communicated during the booking process.
5. Safety and Liability:
5.1. Safety Measures: The Client agrees to follow all safety instructions provided by our guides during the fishing activity. Failure to comply may result in termination of the activity without a refund.
5.2. Liability: While we take every reasonable precaution to ensure the safety of our Clients, fishing activities inherently involve risks. The Client acknowledges and assumes all risks associated with the activity. We shall not be liable for any injuries, damages, losses, or expenses incurred during the activity.
6. Equipment and Supplies:
6.1. Equipment: We provide necessary fishing equipment through our rental program and (most) supplies are included as part of the fishing guide service. Any damage to equipment caused by the Client's negligence or intentional misconduct may result in additional charges.
7. Changes to Itinerary:
7.1. Itinerary Changes: We reserve the right to modify the fishing itinerary due to weather conditions, safety concerns, or other unforeseen circumstances. We will make reasonable efforts to provide alternative arrangements of comparable value.
8. Privacy:
8.1. Data Collection: We may collect and store personal information provided by the Client for booking purposes. We will handle this data in accordance with our Privacy Policy.
9. Consent for Use of Photo and Video for Marketing Purposes:
9.1. Consent: By participating in our fishing guide service, the Client grants [Your Company Name] the non-exclusive right and permission to use any photographs, videos, or other media taken during the fishing activity for marketing and promotional purposes. This may include, but is not limited to, our website, social media channels, brochures, and other promotional materials.
9.2. Exclusion: If the Client wishes to exclude themselves from any promotional materials, they must notify us in writing prior to the fishing activity.
By agreeing to these General Terms and Conditions, the Client acknowledges that they have read and understood the consent for the use of photo and video for marketing purposes outlined in this section.
10. Governing Law and Disputes:
10.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction].

By booking our fishing guide service, the Client acknowledges that they have read, understood, and agreed to these General Terms and Conditions. This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether written or oral.

Physical Merchandise Refunds (Ordered from Our Website):
11.1. Refund Policy: Refunds for physical merchandise (e.g., apparel, accessories) ordered through our website are subject to the following conditions:
11.2. Damaged or Defective Items: If the merchandise received is damaged or defective, the Client must notify us within [2] days of receipt. We will provide a replacement or issue a refund upon return of the damaged item(s).
11.3. Incorrect Items: In the event that the merchandise received does not match the order placed, the Client should notify us within [2] days of receipt. We will arrange for the correct item to be shipped or issue a refund.
11.4. Change of Mind: We do not typically offer refunds for merchandise due to a change of mind. However, if the Client wishes to return an item for a refund, they must do so within [1] day of receipt. The item must be in its original condition and packaging. Refunds will be issued upon receipt and inspection of the returned item, minus any applicable shipping and handling fees.

By making a purchase through our website, the Client acknowledges and agrees to the merchandise refund policy outlined in this section. This policy is in addition to the General Terms and Conditions specified above.
